NY State Issue:

Oppose the proposal to eliminate spousal refusal

Access to care is a major concern for many low and middle income families. Eliminating spousal refusal does not address this issue and only exacerbates the ability for individuals to get appropriate coverage. Spousal Refusal allows legally responsible relatives (souses and parents) to refuse to financially support their spouse or child for purposes of determining Medicaid eligibility. Middle and low income families rely on spousal refusal to preserve their income to make ends meet. This proposal will likely force many couples to divorce and families to go on welfare in order to secure appropriate care for their loved ones.
