Filing a Complaint
If you feel you have been discriminated against, and wish to file a complaint, you have several options. The EEOC which is the federal agency that enforces the ADA or your local office of Human Rights which may have better protections than what the ADA provides and should be consulted first when considering a charge of discrimination. Before fling a charge of discrimiation however, it may be advisable to consult with an attorney as there may be an intermedate step one should consider before moving forward with a formal complaint.
United States Equal Employment Opportunity Commission (EEOC)
The U.S. Equal Employment Opportunity Commission (EEOC) is responsible for enforcing federal laws that make it illegal to discriminate against a job applicant or an employee because of the person's race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information. It is also illegal to discriminate against a person because the person complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit.
Filing a Charge of Discrimination. If you believe that you have been discriminated against at work because of your race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information, you can file a Charge of Discrimination.
All of the laws enforced by EEOC, except for the Equal Pay Act, require you to file a Charge of Discrimination with the EEOC before you can file a job discrimination lawsuit against your employer. In addition, an individual, organization, or agency may file a charge on behalf of another person in order to protect the aggrieved person's identity.
There are time limits for filing a charge.
